Supreme Court denies leave to Senator Duffy — Confirming Exclusive Jurisdiction of Senate to Discipline Members

On February 11, 2021 the Supreme Court of Canada refused Senator Duffy’s leave to appeal to the Supreme Court of Canada.  The court’s refusal leaves the strongly worded of the Ontario Court of Appeal decision as the leading authority in Canada on the exclusive jurisdiction of legislative assemblies to discipline members without review or interference by the courts. As is its practice, the Supreme Court gave no reasons for its refusal For my take on the case as it worked its way through the lower level courts see my blogposts in December 2018 and September 2020
